Preamble
1. This End-User License Agreement (hereinafter referred to as "this Agreement") is entered into by and between you (hereinafter also referred to as the "User") and PARAWULIN PRODUCTION LIMITED (hereinafter referred to as "PARAWULIN"), concerning the installation and use of the game software and related services provided by PARAWULIN. This Agreement is legally binding.
2. Before using the games or services provided by PARAWULIN, you are reminded to read this Agreement carefully and fully understand all of its terms, especially those that exempt or limit PARAWULIN’s liability, restrict your rights, and stipulate governing law and dispute resolution. Please decide whether to accept or not accept these terms. Such clauses may be highlighted in bold for emphasis.
3. If you do not agree to any of the terms of this Agreement, you shall not install or use the games or services covered by this Agreement. Your installation, use, or any related actions shall be deemed as your acknowledgment and acceptance of this Agreement and your consent to be bound by all its terms. You may not thereafter claim that you have not read or agreed to the contents of this Agreement.
Article 1: Definitions and Interpretations
1.1 “Game” or “Games” refers to the game software provided by PARAWULIN, including versions running on gaming consoles, computers, mobile smart devices, or other forms, as well as any related updates, upgrades, patches, or expansions. It includes, but is not limited to, all associated components such as program code, graphics, audio, video, and documentation.
1.2 “Service” or “Services” refers to the online operation services, customer support, and any other related services provided by PARAWULIN in connection with the Games.
1.3 “User” or “Users” means any natural person or legal entity who legally purchases, installs, or uses the Games and related Services provided by PARAWULIN.
1.4 “License” means the non-commercial, revocable, modifiable, non-exclusive, non-transferable, and non-sublicensable right granted to the User by PARAWULIN to use the Games and Services, provided that the User fully complies with all the terms of this Agreement.
1.5 “Third-party Platform” or “Third-party Platforms” refers to gaming platforms operated by third parties other than PARAWULIN, which may be required to access or use the Games or related Services.
1.6 The headings in this Agreement are for convenience only and shall not affect its interpretation.
Article 2: Scope and Restrictions of Use
2.1 Subject to the User’s acceptance of all the terms herein, PARAWULIN grants the User a non-commercial, revocable, modifiable, non-exclusive, non-transferable, and non-sublicensable right to use the Games and Services. The User may install and run one copy of the Game on their personal device and enjoy the related Services provided by PARAWULIN.
2.2 Without PARAWULIN’s prior consent, the User shall not engage in any of the following activities (whether for profit or otherwise):
(1) Reverse-engineering, decompiling, disassembling, or otherwise attempting to obtain the source code of the Game;
(2) Reproducing, distributing, transmitting, or displaying the Game or any of its content;
(3) Publicly performing or broadcasting the Game or its Services in any form or on any platform;
(4) Creating derivative works based on the Game;
(5) Renting, lending, transferring, or otherwise assigning the right to use the Game, or using it for commercial gain;
(6) Removing, modifying, or concealing any copyright, trademark, or other intellectual property notices within the Game;
(7) Engaging in any activity that violates applicable copyright, trademark, or software protection laws and international conventions.
Article 3: Intellectual Property Rights
3.1 PARAWULIN retains all ownership and intellectual property rights in and to the Game and related Services, including all data, source code, concepts, artwork, music, storylines, character designs, audio-visual elements, and documentation (collectively, “Game Content”). Such Game Content is protected by copyright, trademark, and other applicable laws and international treaties.
3.2 The User is granted only the right to use the Game in accordance with this Agreement.
3.3 All rights not expressly granted herein shall be determined through separate negotiations between the parties. However, intellectual property rights and ownership of any new creations developed based on products or services for which User hold ownership or intellectual property rights, or any works incorporating all or part of such products or elements, shall belong to User, including but not limited to the right to create derivative works. The User shall not use PARAWULIN’s names, trademarks, domain names, or slogans without prior written consent.
Article 4: Updates, Support, and Third-party Platforms
4.1 PARAWULIN reserves the right to update, upgrade, or modify the Game at any time to improve functionality, performance, or security.However, User will be notified at least 3 days in advance.
4.2 PARAWULIN shall provide technical support and use its best efforts to resolution of all issues. The User assumes all risks arising from the use of the Game. However, if such risks are caused by PARAWULIN, PARAWULIN shall be liable.
4.3 The User may need to access Third-party Platforms to use the Game or related Services and shall comply with the relevant terms of such platforms. PARAWULIN shall not be liable for any third-party content or services not directly related to its Game.
Article 5: Personal Information Protection
5.1 PARAWULIN will strictly comply with the applicable Personal Data (Privacy) Ordinance (Cap. 486) and other relevant laws of the Hong Kong Special Administrative Region to protect the User’s personal information.
5.2 PARAWULIN shall not disclose the User’s personal data to third parties without consent, except where required by law, for the performance of a contract, for legal proceedings, or for the protection of life, property, or public safety.
5.3 PARAWULIN may, in accordance with its Privacy Policy, collect, store, and analyze gameplay and technical information to optimize user experience and improve service quality.
Article 6: Obligations of PARAWULIN
PARAWULIN shall provide the Game and Services in accordance with this Agreement and ensure compliance with applicable laws in Hong Kong and relevant jurisdictions.PARAWULIN shall not infringe upon User’s intellectual property or other lawful rights
Article 7: Obligations of the User
7.1 The User shall prepare the necessary devices and ensure a secure network environment.
7.2 The User shall comply with this Agreement and all applicable laws of the Hong Kong SAR and other relevant jurisdictions.
7.3 The User shall be responsible for all activities carried out under their account.
7.4 The User shall not infringe upon PARAWULIN’s intellectual property or other lawful rights.
Article 8: Prohibited Conduct
8.1 The User shall not publish, upload, or disseminate any content that:
• violates laws or public morality;
• contains obscene, violent, discriminatory, defamatory, or infringing material;
• spreads malware, viruses, or other malicious code;
• disrupts social order or promotes criminal activities;
• promotes or uses cheats, exploits, or unauthorized third-party software.
8.2 The User shall not interfere with the operation of the Game or its servers, including but not limited to: hacking, modifying data, exploiting vulnerabilities, or using unauthorized plug-ins, bots, or automation tools.
8.3 Any attempt to damage, disable, or disrupt PARAWULIN’s systems or services constitutes a breach of this Agreement and may result in legal action.
Article 9: Disclaimer
9.1 The Game and Services are provided “as is.” PARAWULIN does not guarantee uninterrupted operation or freedom from errors or defects.
9.2 Unless caused by PARAWULIN’s willful misconduct or gross negligence, PARAWULIN shall not be liable for any direct, indirect, or consequential damages, including loss of data or profits.
9.3 The User shall ensure that their hardware and network meet the minimum system requirements.
9.4 Differences between devices or operating systems may cause data incompatibility, for which PARAWULIN shall not be liable.
9.5 PARAWULIN reserves the right to suspend or terminate the Game or Services at any time , provided prior notice is given to User, except as required by law.
Article 10: Suspension and Termination
10.1 If the User violates this Agreement and refuses to rectify the violation or applicable laws, PARAWULIN may suspend or terminate access to the Game and Services without liability.
10.2 For single-player games, all saved data is stored locally on the User’s device and cannot be restored once deleted or uninstalled.
Article 11: Governing Law and Dispute Resolution
11.1 This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
11.2 Any dispute arising out of or relating to this Agreement shall be submitted to the Hong Kong International Arbitration Centre (HKIAC) for arbitration in accordance with the HKIAC Administered Arbitration Rules in force at the time of submission. The seat of arbitration shall be Hong Kong, and the language of the arbitration shall be English.
11.3 The arbitral award shall be final and binding upon both parties.
11.4 If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Article 12: Effectiveness and Amendments
12.1 This Agreement becomes effective upon the User’s selection of “Agree” or actual use of the Game and remains effective until terminated in accordance with this Agreement.
12.2 PARAWULIN reserves the right to amend this Agreement at any time. Updated versions will be published through official channels .Updated versions shall take effect between PARAWULIN and the user upon the user's signature.
12.3 If the User does not agree with the amended terms, they shall immediately cease using the Game and Services.
Article 13: Notifications
13.1 PARAWULIN may notify Users through in-game messages, email, SMS, or official website announcements.
13.2 Users may contact PARAWULIN via the official customer service email: [email protected].
Article 14: Miscellaneous
14.1 The phrase “including but not limited to” is illustrative and not exhaustive.
14.2 This Agreement is originally written in Chinese. In case of conflict, the Chinese version shall prevail.
